Este artículo tiene por objeto explicar cuándo en el estado de necesidad la distinción entre un mal mayor o menor responde al universo ético consecuencialista y desde qué consideraciones no lo haría; segundo, explicar por qué es posible desde el principio del doble efecto la ponderación de la vida humana, aceptando la objetivización de sus parámetros según los efectos de una acción. Por ello, a continuación trataremos en la primera sección el concepto de mal en clave consecuencialista y, posteriormente, moral (...) absolutista. Se trata de un análisis sobre la materia que reconoce, en la segunda sección, la importancia de la existencia de estos universos en la ponderación de males. Luego, contrastaremos nuestros razonamientos con las soluciones que, para casos semejantes, se proponen desde el doble efecto para algunas situaciones de estado de necesidad. Finalmente, en la tercera sección, entregaremos los criterios de una política criminal para distinguir y no encubrir exigencias deónticas en el estado de necesidad. (shrink)

Se indagará en el tipo de lectura de la tragedia que hace el pensador alemán y los alcancesde la relación que podemos establecer entre ella y su pensamiento. A partir del análisis de lasreferencias heideggerianas y de la caracterización de la esencia de la tragedia por parte de Aristóteles,en la que destacan las pasiones del miedo y la compasión, se intentará comprender cómo (...) dichavinculación puede establecerse, al menos, en el ámbito del fenómeno de la disposición afectiva(Befindlichkeit) y su carácter aperiente. Today the definition of Spain as a national, historical and sovereign entity is in crisis. This situation has been reached because the Spanish left has assumed as its own many of the ideas about the concept of the Spanish nation of peripheral nationalisms. In this article we try to discover the causes of this identification through the study of the propaganda texts that the opposition to the Franco regime had on the national concept, rescued in the rulings of the Public (...) Order Court. In them we will observe how the opposition to Francoism in the Basque Country, Catalonia, Galicia and the Canary Islands mixed Marxist and nationalist ideologies in their messages, but with great fundamental differences in each of these regions. Furthermore, we certify that the "Burgos Process" was the turning point that cemented the identification of the Spanish left throughout the country with the nationalist movements. (shrink)

El objetivo de este trabajo es mostrar la importancia que tiene recuperar el concepto de «ideología» y con él la labor de crítica ideológica en la teoría del derecho. En las teorías positivistas de Kelsen y Ross era uno de los conceptos centrales, pero cayó paulatinamente en desuso en la segunda mitad del siglo xx, tanto a nivel político como en el campo específico de la teoría jurídica. En este trabajo se examinan algunas de las razones por las que se (...) dejó de utilizar y se propone un concepto de «ideología» capaz de evitar esos cuestionamientos. Por último, se ponen de manifiesto las consecuencias perjudiciales (tanto teóricas como prácticas) que trae aparejado el abandono de la crítica ideológica en la teoría jurídica. Se utiliza como caso de estudio la concepción postpositivista sobre la naturaleza del derecho defendida por Manuel Atienza y algunas de las decisiones argumentativas que el propio Atienza ha adoptado guiado por ella en una polémica sobre el estatus normativo de la gestación por sustitución en la práctica jurídica española. After examining some of the most fundamental aspects of the general concept of ‘neuroright’ in the current discussion, this paper analyzes the concept of ‘the mental’ contained in the very first law of neurorights in the world currently under discussion in the Senate of the Republic of Chile (Bulletin 13.828-19 of the Chilean Senate). This article is concerned with the Spinozian topic of understanding human actions and its interpretation by Nietzsche in The Gay Science 333. Nietzsche doesn’t read directly Spinoza’s work but rather the volume of Kuno Fischer’s History of Modern Philosophy dedicated to the XVIIth century philosopher; this can be confirmed by the way in which the text is quoted. Even if Nietzsche reduces greatly the power of understanding to one of its aspect translating intelligere as erkennen, it is necessary to emphasize (...) that the aphorism presents a novelty that can enrich the study of the relationship between these two philosophers. Nietzsche identifies conscious thought with the “last scenes of reconciliation” between different drives of a previous unconscious process. Even if the point of departure of this survey is the centrality of affects in both thinkers, it will also identify a precise limit which distances Spinoza’s understanding of the affects from the centrality of drives in Nietzsche’s philosophical project. In lieu of an abstract, here is a brief excerpt of the content:Hispanic Utopian Studies and Activism as a PromptJulia Ramírez-Blanco (bio)In the last few years I have come to the Utopian Studies Societýs yearly conference as part of a smaller group, one that has its own parallel history in the left corner of the South of Europe and is networked mostly with Latin America. I am referring to the interdisciplinary research group Histopia, which has its base in Madrid́s (...) Autónoma University, is comprised of twenty-seven researchers from different institutions, and is coordinated by historian Juan Pro. As the name Histopia suggests, it was founded by historians. From the beginning there have been people from other fields, such as political science, architecture, cultural studies, and art history. The aim was always understanding utopianism beyond the study of texts, and centering research in everything that utopianism produces, such as social movements, political programs, and urban programs. In this sense, a premise was to understand utopias not as a footnote in history or a series of eccentric events, but as a guiding force that drives a [End Page 510] history. This placing of utopianism in history was clearly announced in the grouṕs website:Histopia seeks to go beyond the philological approach that predominates in Utopian Studies and to historicize the study of contemporary utopias and dystopias, showing how they respond to the contexts in which they arise, since they reflect the problems and frustrations of a society as well as the aspirations for change it contains, and the conditions of possibility that a particular cultural and emotional framework offers for developing them.1Together with this focus on history, which departs from the more text-centered traditions of an important part of utopian studies, the other main particularity of Histopia is its decentralizing of utopian studies towards the Spanish-speaking world. And to this end, the group also founded the Transatlantic Network for the Study of Utopias, which was created in 2015 to put in communication over 250 researchers, most of them from Latin America, but also from other places such as Australia or Japan.2The Spanish statés research funding programs have provided the bureaucratic framework and the material resources for the research group since 2015. Together with seminars, conferences, or workshops, the resulting publications have been linked with utopian literature, with dystopia, and with a focus on viewing history through the lens of utopia. One of the most recent endeavors has been a radically collective one, articulating a Dictionary of Utopian Places written by a multitude of authors.3 Histopia has also initiated several projects with schools, for the most part ongoing, and there have been many attempts to disseminate its work through radio and video projects. And since its founding, Histopia has tried reaching out beyond the Academy—an effort that is finally gaining success. In 2021 the international conference Intentional Communities: Concrete Utopias in History was extremely fruitful: we saw involved participation both in various interventions, and through activities such as streaming. Participants included people and organizations from social movements and from intentional communities.I want to argue here that the very formation of Histopia was a logical development from certain political triggers—and in particular, the so-called 15M Movement, a series of anti-austerity protests and direct-democracy initiatives that ignited antigovernment activism throughout Spain from 2011 on, culminating in the occupation of urban spaces (“encampments”) and in very large political assemblies. El presente artículo traza la semblanza intelectual y profesional del religioso José Mª Salvador y Barrera, natural de Marchena, que llegó a ser Rector del Colegio del Sacro Monte de Granada, Obispo de Tarazona, Obispo de Madrid-Alcalá, Arzobispo de Valencia y Senador, y que dedicó todos sus esfuerzos a defender la enseñanza religiosa y la acción social de la Iglesia desde los altos puestos que ocupó. Fue además un excelente orador y persona de gran cultura, siendo reconocida su labor (...) por las Reales Academias de la Historia y de Ciencias Morales y Políticas, que le eligieron como académico de número. Autonomía significa capacidad de otorgarse la ley a uno mismo; atendiendo a su etimología (de "autós" -uno mismo- y "nomos", ley), consiste en tener la ley en uno mismo, o, más precisamente aún, ser uno mismo su ley. En el discurso ético, el término aparece con Kant, pero la noción y la problemática que se quieren significar con él es mucho más antigua. Ya aparece nada menos que en los capítulos segundo y tercero del Génesis. En ellos se narra que (...) en el paraíso la primera pareja humana recibió un mandato de Dios :"Puedes comer de todos los árboles del jardín; mas del árbol de la ciencia del bien y del mal no comerás en modo alguno, porque el día en que comieres, ciertamente morirás". Pero sufrieron una tentación, con el argumento de que "Dios sabe que en el momento en que comáis se abrirán vuestros ojos y seréis como dioses, conocedores del bien y del mal", y cayeron en ella. Prescindiendo del decorado, no es difícil entender que lo que aquí está en juego es la decisión sobre el bien y el mal. El hombre reclama para sí el establecer -según su ciencia, eso sí- qué está bien y qué está mal, lo que en el relato se había reservado Dios para Sí mismo. Quiere por tanto ser el origen de la ley por la que debe regir sus actos: en una palabra, quiere ser autónomo. Como puede verse tanto por el tiempo en que se escribió el relato como más aún por el tiempo al que se refiere, la cuestión es vieja. Y es crucial. No se trata de tal o cual obligación moral, sino del origen mismo de la obligación. (shrink)

Sainsbury 2005 and 2009 offers a theory of empty names that purports to account for the content and truth-value of all utterances involving them. The goal is to do this while offering a homogenous semantic treatment: both empty and nonempty names make the same kind of contribution to truth-values. The account is based on a new theory of reference that purports to be an alternative among nondescriptivist accounts. According to the new theory, there is reference even without referents. In this (...) paper I argue that the theory does not offer a homogeneous semantics for names and that, thus, it fails to offer a more satisfactory alternative to the theories already available. I conclude by briefly describing a way in which a theory could in fact offer such homogeneous semantics for names via a cognitive theory of empty names. (shrink)

Here I present a counterexample by means of the Wookiee problem. After considering several options I offer what appears to be its most satisfactory solution. This requires that we give up the assumption in favor of a view according to which it may be that semantic information does not at all determine the content (...) of an assertion, not even partly so. This article intends, firstly, to enrich the study of the role that the concept of tone plays in Kantian idea of reason, by extending it to the analysis of music as art of sounds, which the Critique of Judgment fulfills. Secondly, it aims to determine the grounds that could explain why the mathematics, due to the specificity of the philosophical method and the physical reception of music, respectively, are itself incapable to express the procedures of reason and of the art (...) of sounds. Finally, it points out a similarity between reason and music concerning their common rejection of succumbing to the Schwärmerei, although the distance which divides them as two contrary ways to exercise and promote the life and its feeling.O artigo tenciona, primeiramente, enriquecer o estudo da função que o conceito de tom desempenha na ideia kantiana de razão, ao estendê-lo à análise da música como arte dos sons que a Crítica do Juízo contém. Em segundo lugar, propõe-se determinar os motivos pelos quais a matemática se revela incapaz, devido à especificidade do método filosófico e à corporalidade da recepção musical, respectivamente, de expressar o modo de proceder da razão e da arte dos sons. En el texto se presenta a la sofística como precursora de la filosofía práctica, y se la reconoce como anticipadora del pensamiento aristotélico. La vía por la que se muestra dicha relación es el reconocimiento del papel primordial que esta concede al lenguaje y en especial al que adquiere la forma de discursos que buscan persuadir, a la retórica como piedra angular de la formación ciudadana en cuanto preparación para la vida pública. De esta manera se reconoce la importancia que (...) la retórica tuvo para la filosofía en sus orígenes, y cómo perfilaba otra manera de entender la racionalidad, no como teórica sino como práctica. Después se pasa a mostrar cómo según Chaïm Perelman, a partir de una reinterpretación de cierta parte de la obra de Aristóteles, es plausible postular a la retórica como un modelo más adecuado para entender la filosofía. The year 1992 is a year for reflection, because whether or not the quincentenary celebration of the arrival of the Europeans to this continent seems justified, one cannot escape thinking about the impact of this event on our land.As archeology is my area of study, my reflections are directed toward the changes that came about in the relationship between man and animals after 1492, specifically toward what occurred in Mexico once the Spaniards established themselves in this territory.

This chapter argues that from a particularly weak recombination principle and plausible assumptions about the nature of parthood and location, it follows that it is possible that the mereological structure of the material world and that of space-time fail to correspond to one another in very radical ways. The chapter suggests, moreover, that rejecting the possibility of such failures of correspondence leaves us with a choice of no less unappealing alternatives. We propose that marketing of unhealthy foods and beverages to Black and Latino consumers results from the intersection of a business model in which profits come primarily from marketing an unhealthy mix of products, standard targeted marketing strategies, and societal forces of structural racism, and contributes to health disparities.

En base a una confrontación estrictamente racional con la tradición filosófica, Plotino establece un principio transcendente al ser y al pensamiento y que, sin embargo, funge como principio creador, constitutivo y diferenciador de todo lo existente: el Uno o la Unidad absolutamente simple. En sí mismo inaccesible, se manifiesta ya sea por revelación (la cual sólo es una hipótesis para Plotino) o por sus efectos. Por eso, el discurso filosófico sobre el Uno sólo es posible desde la perspectiva de la (...) multiplicidad y, por tanto, tiene un carácter aproximativo. La forma que este discurso asume es necesariamente la de las vías analogiae, eminentiae y negationis.
